Ex-IRS Special Agent Charged With Filing False Tax Returns

Law360, San Francisco (October 21, 2016, 8:14 PM EDT) — A former Internal Revenue Service special agent was indicted by a federal grand jury in Sacramento on Thursday on charges she filed false tax returns from 2009 to 2011 for herself and her family, made false statements to the Treasury Department and tried to obstruct a federal investigation into her alleged fraud.
The indictment alleges Alena Aleykina, the certified public accountant who served as an IRS criminal investigation agent from 2006 to 2014, falsified her own tax returns while she worked for the government as an investigator. It says she claimed nearly $40,000 worth of false deductions during the three-year period starting in 2009, “corruptly endeavor[ing] to obstruct and impede the due administration of the internal revenue laws.”
She also stands accused of filing false returns for family members and trusts, giving false statements to the Department of Treasury and receiving unearned $1,000 in Tuition Assistance Reimbursement payments through false statements in her taxes.
The indictment further alleges she tried to cover up the fraud by destroying evidence on a government computer, “with the intent to impede obstruct, and influence the investigation and proper administration of at least one matter within the jurisdiction of a department or agency of the United States.”
Aleykina has been charged with six counts of filing false income tax returns, one count of corruptly endeavoring to obstruct the internal revenue laws, one count of theft of government money and one count of destroying records during a federal investigation. She faces a statutory maximum sentence of 51 years for all her charges.
Representatives with the Department of Justice were not immediately available for comment Friday.
The government is represented by Assistant U.S. Attorney Thomas Newman of the Department of Justice and by Gregory Bernstein and Charles O’Reilly of the DOJ’s Tax Division.

The case is USA v. Aleykina, case number 2:16-cr-00142, in the U.S. District Court for the Eastern District of California.
